The inspection conclusion shows that, in the supervision and use of subcontractors participating in the implementation of the Hanoi Pilot Urban Railway Construction Investment Project, Nhon – Hanoi Station section (CP Package -01, CP-02), at the time of adjusting the price of bidding package CP01 and bidding package PC02, the Investor has not yet made the adjustment estimate according to the direct compensation method, adjustment coefficient or adjustment method. adjusted by the construction price index as prescribed in Clause 2 and 3, Article 11, Decree No. 112/2009/ND-CP dated December 14, 2009 of the Government on construction investment cost management; Clause 3, Article 36 of Decree No. 48/2010/ND-CP dated May 7, 2010 of the Government on contracts in construction activities and Clause 1, Article 7 of Circular No. 08/2010/TT-BXD dated May 29 /7/2010 of the Ministry of Construction guiding the method of adjusting construction contract prices “when adjusting contract prices according to the formula, the input database to calculate the price adjustment must be consistent with the content of the work.” in the contract” leading to inaccurate payment and finalization of bidding packages CP01 and CP02.

Specifically, Dong Da District People’s Committee issued a notice of land recovery in 2012 and handover of the site (Station S10, 11) from 2016 – 2022 will be completed (the delay is mainly in the period 2016 – 2020); Hoan Kiem District People’s Committee issued a notice of land recovery in 2013 and handover of the site (Station S12) from 2017 – 2019 was completed; Ba Dinh District People’s Committee issued a notice of land recovery in 2013 and handover of the site (S9 Station) from 2016 to 2022.
According to the Hanoi City Inspectorate, the above contents have not been implemented on time as prescribed in Article 67, Article 68, Article 69, Article 70, Article 93 of the 2013 Land Law; Clause 2, Article 108 Construction Law No. 50/2014/QH132: “The deadline for construction site clearance must meet the requirements for project implementation progress approved or decided by the competent person”; The site clearance schedule has not been implemented according to the direction of the Hanoi People’s Committee.
In addition, the project’s technical infrastructure relocation work has not yet been completed, leading to the extension of the Hanoi City Pilot Railway Project, Nhon – Hanoi Station section.
After the inspection, the Hanoi City Inspectorate proposed that the Hanoi People’s Committee assign the Department of Home Affairs to consider the responsibilities of organizations and individuals for the problems mentioned in the conclusion to advise the City People’s Committee on how to handle them. according to the law.
Along with that, direct the Hanoi Urban Railway Management Board to organize inspection and review of unit prices applied in preparing, appraising and approving initial estimates for bidding packages No. CP01, CP02 as a basis for Make price adjustments according to regulations for contractors implementing the CP01 and CP02 packages, on the basis of inspection and review as a basis for payment and settlement with the unit implementing the CP01 and CP01 packages.
