Previously, around 2014, Mr. Ha Van Tam held the position of Vice Chairman of Tan Minh Commune People’s Committee, and Head of Enh Market Management Board, along with Mr. Xa Viet Xuan, Chairman of the Commune People’s Committee and Mr. Xa Van Tien, Party Secretary. The Commune Party Committee held a meeting of the Tan Minh Commune Party Committee to agree to sell the land plot in the Enh market cluster managed by the People’s Committee of Tan Minh Commune to Mrs. MTN’s household, residing in Tan Minh Commune.

After the meeting to discuss and reach a consensus, Mr. Xa Viet Xuan and Mr. Ha Van Tam directed Luong Van Ngoc, a commune cadastral official, to guide Ms. MTN’s household in completing the procedures to apply for a Land Use Rights Certificate. To be granted a Land Use Rights Certificate, Ms. MTN’s family had to pay a total amount of 260 million VND, of which Mr. Ha Van Tam received 30 million VND, Mr. Lo Van Lai received 40 million VND.
Based on the documents and evidence collected, the Police Department of Hoa Binh Province issued a decision to prosecute the defendant; Order to arrest the suspect for temporary detention; Search warrant for Mr. Ha Van Tam (November 22, 2023) and Mr. Lo Van Lai (December 28, 2023) for the crime of “Abusing position and power while performing official duties” specified in Article 356 of the Penal Code.
Currently, the case is being further investigated and handled by the Hoa Binh Provincial Police Department.
