The use and robo from Photographs from minors between 12 and 18 years old published on their social networks to create a false profile to claim on the contact or pornography pages payment is not, at this time, a crime. Hence, the Barcelona computer crime prosecutor Roberto Valverde considers that this attitude should be included in the Penal Code and classified as a criminal offense, with its corresponding penalty. “It cannot be that the commission of these acts is free,” he asserts.

The prosecutor warns that, after confinement due to the covid pandemic, in the province of Barcelona Between 10 and 20 complaints are being received per month for the fraudulent use of images of minors to promote web pages. This practice, in his opinion, has been fostered by the greater use of social networks during confinement, but also by the overexposure of the teenagers on those platforms, a trend that has been increasing in recent years.

Over the past few months, the police have begun to receive complaints from parents of minors who have found that photographs that their daughters had posted on their Internet profiles in a bikini or with little clothing were being used to advertise or promote pornography or contact portals. According to Valverde, these types of websites download the images that the minors freely hang on the networks, making it difficult for their use to be prosecuted by criminal means. Although these facts do not fit in the Penal Code for now, parents have the option of filing a civil lawsuit to claim compensation and urge the platform to remove the stolen photograph.

The judicial and computer forensic expert Bruno Pérez Juncà explains that this usurpation of images of minors on social networks may be due to cases of ‘bullying’ or harassment, but that it also works as an extortion mechanism. “They steal your identity and tell you that they have created an account OnlyFans with your images, “he explains. Although it is a lie, that serves as coercion to harm his digital reputation, something that for minors is essential. “His whole personal and professional life depends on it.”

Child pornography

This is not the only cybercrime that increased during the pandemic. So did those related to child pornography. During 2020, 61 procedures were initiated for this type of crime in the province of Barcelona, which represents an increase of 169% compared to the previous year. In Spain, according to Valverde, they have tripled. The crimes of harassment of minors through telecommunications, on the other hand, they have doubled in Barcelona (61 judicial proceedings last year). There is a lot of unreported crime.

The memory does not include any criminal investigation underway by the internet portals that apologize for eating disorders, one of the health problems that, according to doctors, has affected adolescent girls the most during confinement. The persecution of these internet pages was limited until last July, when incitement to this conduct was typified, as well as the induction of self-harm, in the law for the comprehensive protection of childhood and adolescence.

Revelation of secrets and others

Other criminal categories that have resulted in a “statistical increase worthy of consideration“According to Valverde, it is the one of honeycomb infractions in which the object of the illicit activity is the computer systems themselves or the information technologies (ICT). It highlights the following: discovery and disclosure of secrets (interception of transmissions, such as emails or messages) with the violation of another person, which have gone from 29 cases in 2019 to 55 in 2020. Computer damage has gone from 14 to 24 initiations of criminal proceedings.
