Nancy: application for interim relief
This weekend, Nancy is hosting a literary event of national significance: the Book on the Place. However, the prefecture of Meurthe-et-Moselle does not want to hear about a demonstration in the city center because of possible disturbances to public order. The prefecture therefore announced an enlarged perimeter within which any demonstration was prohibited under penalty of a fine of 135 €.
“We do not want to hamper trade and even less visitors to Le Livre sur la Place,” explains Kévin, one of the spokespersons for the Bloc Lorrain, organizer of the anti sanitary pass demonstration. We have been demonstrating for eight weeks without any slippage or disturbance to public order. “
The organizers asked their lawyer, Me Christophe Sgro, lawyer at the Court of Appeal of Nancy, to present a summary release to the president of the administrative court of Nancy in order to “suspend without delay the decree of September 9, 2021 , by which the Prefect of Meurthe-et-Moselle prohibited any demonstration on the public highway, on Saturday September 11, 2021, from 6 am to 10 pm, in NANCY ”over a large area (see below). The lawyer explains that “the contested decree seriously undermines the freedom to demonstrate and the
right to collective expression of ideas and opinions, to freedom of assembly, and to freedom of association. “
For Me Sgro, the prefect can not invoke the disturbance of public order since the demonstrators, in eight weeks, “caused no damage”.

The city center of Nancy is hosting the 43rd edition of the Livre sur la Place on September 10, 11 and 12, a cultural event of national significance, during which the arrival of 100,000 visitors and 500 authors is scheduled over the three days.
In order to prevent any disturbance to public order and to take into account the expected crowds, especially on Saturday 11, a expanded scope of prohibition to demonstrate is taken by prefectural decree from 6 a.m. to 10 p.m. (see below). The latter integrates the various places of programming, signatures and dedications, such as bookstores which could be particularly crowded for the occasion. At the same time, and as part of a national appeal, a protest demonstration, declared in the prefecture, is scheduled in Nancy on Saturday September 11, 2021 from 2 p.m., for the ninth consecutive Saturday.
Despite numerous exchanges since the beginning of the week between the state services and the organizers of the event, the latter have chosen to declare a route that penetrates the perimeter of prohibition to demonstrate previously defined.
Noting with regret this situation, Arnaud COCHET, Prefect of Meurthe-et-Moselle, cannot issue a receipt for this event. He recalls on this occasion that demonstrators who do not respect the perimeter of prohibition to demonstrate are exposed to a fourth class fine in the amount of € 135 (article R.644-4 of the Penal Code).
