The author of the video about rotten beef has recovered non-pecuniary damage from ZAO Nazarovskoye

Dmitry Zubkov, the author of the video about rotten beef, filed a lawsuit against CJSC Nazarovskoye in the Achinsk City Court seeking compensation for non-pecuniary damage in the amount of 2.5 million rubles for violating his rights.

The essence of the requirements was that when finding a job at a meat processing plant as an auxiliary worker, he was involved in work without a health book, without passing the appropriate medical examination, and was also not provided with personal protective equipment. In addition, he noted that under the threat of dismissal and imposition of penalties, he was forced to butcher rotten beef and add it to sausage. He also demanded to compensate for the expenses incurred for food and to pay for non-pecuniary damage. Being a person serving a sentence in the form of forced labor, he was forced to work in conditions that violated his labor rights, he could not refuse to work under the threat of returning him to places of deprivation of liberty.

The defendant did not appear at the court session and sent a response in which he did not agree with the requirements of Dmitry Zubkov. He also noted that during the period of work, the plaintiff did not make claims to the company regarding working conditions and safety. He was provided with special clothing and footwear, taking into account the work performed, which is confirmed by his signatures in the personal card for issuing personal protective equipment. The obligation to provide workers with medical books was assigned by an agreement to FKU IK-31 of the GUFSIN of Russia in the Krasnoyarsk Territory.

The representative of a third party, FKU IK-31 of the GUFSIN of Russia for the Krasnoyarsk Territory, in his response noted that in accordance with the terms of the agreements concluded with Nazarovskoye CJSC on the selection and provision of workers from among persons serving sentences of forced labor, the company accepted obligations to provide and organize meals for workers at the lunch time established by the contract, as well as to provide all workers with special clothing and footwear for the season in accordance with standard standards of provision. From FKU infringements of the current legislation is not admitted.

“The court considers that CJSC Nazarovskoye committed a violation of the labor rights of Zubkov D.P., expressed in untimely and incomplete provision of the employee with special clothing and footwear, personal protective equipment, in the organization and failure to provide the employee with food, engaging in work with spoiled raw materials without additional provision with personal protective equipment, in connection with which he has the right to compensation for the moral damage caused to him, ”quote from the court decision.

After hearing the plaintiff and examining the evidence presented, the court partially satisfied Zubkov’s claims – he exacted 25,000 rubles in compensation for non-pecuniary damage from CJSC Nazarovskoye in his favor. The decision has not entered into force and can be appealed to a higher authority. It is worth noting that in this trial, the arguments of the plaintiff were not refuted by the defendant.

Recall that in the summer of 2021, having shown a civic initiative, Dmitry Zubkov filmed what was happening at the Nazarovskoye meat processing plant, when 56 tons of rotten beef could be put into sausage. What was happening caused a resonance in society, and the author began to receive threats. After the scandalous exposure, the Association of Agricultural Producers, Processors and Trade, in connection with the results of the production audit and consumer complaints in social networks, suspended certificates for the company’s products. Subsequent inspections by the prosecutor’s office, Rosselkhoznadzor and Rospotrebnadzor revealed microbes and E. coli in raw materials:

“Contrary to the requirements of the law, the inspection revealed traces of rodents, insects in the workshops and premises of the enterprise. The production control over the quality of the raw materials used, the mode of storage and use in the production process was improperly organized. The bacteria of the group coli, as well as microbes in excess of the permissible amount. Violations of the technological process and temperature regime during storage and cutting of meat products were revealed, “the regional prosecutor’s office reported then.

Penalties totaling 125,000 rubles were imposed on the culprit for these violations.
