DIJON: Demonstrations banned in several sectors on Saturday September 11

The prefecture of the Côte-d’Or banned the demonstration this Saturday, September 11, several roads and sectors of Dijon: the CHU, the station, the prefecture and the square des Ducs.

Prefectural Decree No. 1217 prohibiting the holding of a demonstration in certain sectors of the city of Dijon on Saturday September 11, 2021 from 12 p.m. to 9 p.m.

The prefect of Côte-d’Or
HAVING REGARD to the Internal Security Code, in particular Articles L. 211-1 to L. 211-4;
CONSIDERING the penal code and in particular its articles 222-14-2, 431-3 et seq. And R. 644-4;

CONSIDERING the law n ° 82-813 of March 2, 1982 as amended relating to the rights and freedoms of municipalities, departments and regions;
CONSIDERING Decree No. 2004-374 of April 29, 2004, as amended, relating to the powers of the prefects, the organization and action of State services in the regions and departments;
CONSIDERING the decree of July 29, 2020 appointing Mr. Fabien SUDRY, Prefect of the Bourgogne-Franche-Comté Region, Prefect of Côte-d’Or;
CONSIDERING that it is for the competent police authority to reconcile the exercise of the right to demonstrate with the imperatives of public order; that in this context, it must take measures likely to prevent, in addition to offenses against criminal law, disturbances to public order, based on the assessment it makes of the risk that they arise, as well as their intensity;
CONSIDERING that, therefore, these objectives are met by measures which define the perimeters in which restrictions on the right to demonstrate are taken and which present risks of serious disturbances to public order, in order to guarantee the safety of persons and property ;
CONSIDERING that calls to demonstrate to protest against the health pass were relayed by several informal collectives for Saturday September 11, 2021 at 2:00 pm Place de la République in Dijon;
WHEREAS the said gathering is likely to bring together 1,200 to 1,500 people including individuals at risk, from determined to violent;
CONSIDERING that since July 14, 2021, numerous spontaneous or summarily organized demonstrations have taken place in Dijon against the health pass and “anti-social reforms”, through calls on social networks; that these demonstrations were not the subject of any declaration to the services of the prefecture as required by law, and were the scene of clashes with the police;
WHEREAS the gathering scheduled for Saturday September 11, 2021 at Place de la République in Dijon has not been declared at the prefecture; that in the absence of a declaration and therefore of an identified organizer, the police authority is not able to ensure the implementation of sufficient security conditions and internal to the event;
CONSIDERING that during the undeclared rally organized on Saturday July 24, 2021 against the health pass and “anti-social reforms”, the demonstrators did not respect the prefectural order prohibiting the holding of this demonstration in a perimeter of the city center from Dijon; that on this occasion, incidents broke out in particular near official buildings (prefecture, town hall); that during these disturbances, demonstrators were armed with sticks and other weapons by destination and that numerous and dangerous projectiles were launched in the direction of the internal security forces;
WHEREAS during the undeclared rally organized on Saturday July 31, 2021 against the health pass and “anti-social reforms” the demonstrators entered the perimeter of prohibition of demonstrations in downtown Dijon; that on this occasion the police were the target of projectiles (type F3 and F4 firecrackers in particular); that in view of these violent behaviors, the security forces carried out the dispersal of the demonstration on several occasions after summons;
WHEREAS during the undeclared rally organized on Saturday August 7, 2021 against the health pass and “anti-social reforms” the demonstrators did not respect the ban on demonstrating on certain roads and public spaces in downtown Dijon; that on this occasion the demonstrators tried to force the stop barriers put in place and did not respect the instructions formulated by the police; that new disturbances to public order have arisen in particular around the Dijon SNCF train station, which is particularly busy at weekends;
CONSIDERING that during the undeclared rallies organized on Saturday August 14, 2021 and Saturday August 21, 2021 against the health pass and “anti-social reforms” demonstrators came into contact with the police and tried to reach the sector from the SNCF train station, prohibited by prefectural decree;
WHEREAS during the undeclared rally organized on Saturday August 28, 2021 against the health pass, the demonstrators tried to reach the Dijon university hospital center;
CONSIDERING that during the undeclared rally organized on Saturday 04 September 2021 against the sanitary pass, the internal security forces were the subject of projectiles and had to respond by use of tear gas; that the demonstrators entered the sector prohibited by prefectural decree in which the big back-to-school clearance sale was held;
CONSIDERING the high probability of a new attempt to move demonstrators to the Dijon SNCF train station area and the Dijon university hospital, likely to seriously disrupt access to users of these places;
CONSIDERING the hostility of the procession towards the police force and the declared will of certain demonstrators to go to several public administrations in order to commit degradations;
CONSIDERING that the historic city center of Dijon, located in a protected area, is made up of buildings side by side, narrow alleys, some of which are pedestrianized and that it houses a large number of public buildings (prefecture, bank of France, regional council, departmental council, town hall, administrative city); whereas the intervention of the police is particularly delicate in this sector;
CONSIDERING the impact on the economic activity of traders and the many inconveniences for downtown users that the event is likely to cause;
CONSIDERING that the staff of the security forces cannot be permanently distracted from the other missions incumbent on them, in particular the prevention of the terrorist threat, which is still very significant, and the control operations linked to compliance with health instructions in the context of the crisis in Covid 19;
CONSIDERING that, given the systematic and recurrent nature of the violence since the beginning of the movement against the health pass and the “anti-social reforms”, which go beyond the framework of the freedom to demonstrate, the ban on demonstrating in certain sectors of the city of Dijon is the only one capable of effectively and proportionately preventing disturbances to public order;

ON the proposal of the chief of staff of the prefect of the Bourgogne-Franche-Comté region, prefect of the Côte d’Or,

STOPPED

Article 1: Any gathering, demonstration or procession, of individuals or groups, within the framework of calls to demonstrate against the sanitary pass is prohibited in certain sectors of the city of Dijon as shown on the plans annexed to this decree on Saturday September 11, 2021 between 12 p.m. and 9 p.m.

Article 2: Any breach of the provisions provided for by this decree is punished by the fine provided for fourth class contraventions in accordance with the provisions of article R. 644-4 of the aforementioned penal code.

Article 3: This decree may be the subject, within two months of its publication in the Prefecture and in the town hall, of a contentious appeal before the administrative court of Dijon which may be accompanied by a summary appeal. provided for by article L. 521-2 of the code of administrative justice.

Article 4: The secretary general of the prefecture of the Côte d’Or, the chief of staff of the prefect of the Bourgogne-Franche-Comté region, prefect of the Côte d’Or, and the departmental director of public security are responsible, each as far as he is concerned, of the execution of this decree which will be published in the collection of administrative acts of the prefecture, displayed in the prefecture, transmitted to the town hall of Dijon and sent for copy to the public prosecutor near the court Dijon court.
