BGH overturns judgment against Berlin official for smuggling in foreigners

The Federal Court of Justice (BGH) has overturned the conviction of the employee of a Berlin citizens’ registration office, who is said to have provided foreigners with pseudo-legal residence permits. The district court of the capital has to renegotiate the case again. (Ina FASSBENDER)

The Federal Court of Justice (BGH) has overturned the conviction of an employee of a Berlin Citizens Registration Office who is said to have provided foreigners with pseudo-legal residence permits. The district court of the capital had to renegotiate the case, the BGH announced on Tuesday in Karlsruhe. It had rejected a request by the accused to hear a witness on his defense with unsustainable justification. (Az. 5 StR 550/22)

The woman is said to have entered supposed residence permits in the passports of foreign nationals in exchange for money. A year ago, the regional court sentenced her to four and a half years in prison in seven cases for smuggling foreigners into crimes involving particularly serious bribery and document forgery. A co-accused was sentenced to three and a half years in prison. The BGH has now overturned this judgment as well, and the case must also be renegotiated. (Az. 5 StR 39/23)
